What is an eidesstattliche Versicherung?
An eidesstattliche Versicherung (also called Versicherung an Eides statt) is a sworn statement made before an authorised official, such as a notary, court registrar, or consular officer. Unlike a simple written declaration, it carries legal weight: making a false statement is a criminal offence under German law (§§ 156, 161 StGB), punishable by up to three years in prison. This is according to the German legal definition.
German authorities treat affidavits as an ultima ratio, a last resort when you genuinely cannot obtain the original civil-status documents. The Standesamt or embassy will typically only accept an affidavit after you've demonstrated that getting the original document is impossible or unreasonably difficult.
